I. GENERAL TERMS
‣ I reserve the right to decline a commission without reason or explanation.‣ Please communicate in English with clear and understandable grammar.‣ When providing a reference, please include any and all details relevant to your commission so they will not be left out.‣ When providing a reference, please do not have it shaded!‣ Inappropriate/aggressive behavior of any kind will NOT be tolerated. Should this breach on the Terms of Service occur, I reserve the right to cancel the commission.‣I cannot and WILL not be responsible for a client's budgeting. Please be sure you have the means to purchase before asking for a commission - otherwise, I ask for you to not request my services until you are able to do so.
II. PAYMENT
‣ Payments are Cash App only (for now).‣ ALL commissions are to be paid up in full up front. ( I can also do half and half payments if requested. )‣ I accept payment in USD only.‣ I will not accept a payment until I have finished another clients commission!
III. PROCESS
‣ A Work in Progress ( WIP ) will be given upon request, or at my discretion to make sure everything in your commission is correct before completion.‣ I allow one or two big changes during the WIP phase. Changes after that will be charged extra.
‣ Please allow between one month and 3 month turnaround for commissions. Larger/more complex commissions will result in longer wait time.
DELAYS MAY OCCUR DUE TO ONE OR MORE FACTORS, INCLUDING BUT NOT LIMITED TO: Health, Order of commission, Complexity of Commission, Work, School, or Family issues.IF ANY OF THESE OCCUR, YOU WILL BE NOTIFIED AS SOON AS POSSIBLE!
IV. COPYRIGHT | USAGE
I retain full commercial and distribution rights to any commissions I produce. I do not claim ownership or the rights to intellectual property or the character(s) depicted in the final products unless they are of my own.
As the artist, I am permitted to do the following:‣ Post the artwork on any website/social media of my choosing.‣ Crop, edit, or alter the image for promotional use.
‣ Make prints, digital portfolios, CD's, books, ect. of the artwork.
The client is allowed to:‣ Use the copyrighted artwork for personal use only, unless agreed otherwise.‣ Print the art and claim the right of their character(s), but not the artwork itself.
‣ Post the artwork in their personal galleries, with full credit given to the artist.
Anything created by me may NOT be used in any blockchain-related technology, to include NFT's, cryptocurrency, A.I. or future inventions in the space. Failure to comply WILL result in a court hearing!
If a client's commission has been stolen, misused, or falsely claimed by another individual, the client may report a removal request OR reach out to me to request removal.
SHOULD COPYRIGHT INFRINGEMENT OCCUR, THE CLIENT'S RIGHTS TO THE ART WILL BE FORFEIT.
The following is considered Copyright Infringement:‣ Reproducing, redistributing, or using the copyrighted artwork commercially.‣ Reselling/making money off the art without the artist’s prior consent.‣ Claiming credit for the creation of the artwork.
‣ Removing any watermarks/signatures.
‣ Altering the artwork without my, the artist's, consent.
‣ Using said artwork for A.I. Generated "artworks".
V. CANCELLING | REFUNDS
I reserve the right to cancel a commission and refund accordingly at any time.
‣ I will only refund if one of the following occurs:
- I cannot physically finish your product.
- You are rude, impatient or aggressive.‣ Please note that art is a luxury and I use the money for bills, food and medical/hygienic necessities and will not refund you unless I need to. Be sure you WANT the commission before paying me! I am flexible and can work our a system that benefits both of us.‣ False chargebacks/claims will result in the client being blacklisted from all future purchases.
